The Investigation: Garrity Warning
There are various interpretations of the Garrity Warning but I chose the one below from Wayne St. University as it defined Garrity as I understood it in the context of the Macho B investigation.
“Under Garrity state (and federal) employees can be disciplined and even dismissed for refusing to answer questions in an internal investigation, but if they choose to provide information under these conditions the information disclosed cannot then be used against them in a criminal investigation.”
All AZGFD employees questioned during the AZGFD internal administrative investigation into Macho B’s capture, re-capture, and death were given the Garrity Warning. All USFWS employees questioned in the USFWS criminal investigation into Macho B’s capture, re-capture, and death were given the Garrity Warning. Essentially, Garrity is a government worker’s protection of their fifth amendment rights.
